Appendix A: Specific Privacy Information & Rights

This Appendix contains additional information relevant to specific state laws and regulations regarding data privacy, including the rights that may be available to residents of these states. The information below applies if you are a resident of the specific state, and the relevant rights will be available from the date that the state laws and regulations become effective. This Appendix supplements the content provided in our Privacy Policy and should be read in conjunction with our Privacy Policy.

CALIFORNIA RESIDENTS: YOUR CALIFORNIA PRIVACY RIGHTS

The California Consumer Privacy Act of 2018, as amended, and any implementing regulations (collectively, the “CCPA”) provides consumers residing in California with rights relating to the access, deletion, correction, sharing, and selling of personal information for California residents. We provide this information to inform you of your rights under the CCPA and how to submit a request. Any terms defined in the CCPA have the same meaning when used in this notice. The Notice at Collection for California residents can be found in Section 1 of the Privacy Policy. Residents of California have the following rights subject to applicable exceptions and limitations set forth in the CCPA:

Your Right to Know. You have the right to request that we disclose personal information that we have collected about you. This includes a request for any or all of the following:

  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information is collected;
  • The categories of personal information that we sold or disclosed for a business purpose about you;
  • The categories of third parties to whom the personal information was sold or disclosed for a business purpose; and The specific pieces of personal information that we have collected about you on or after January 1, 2022.

Your Right to Delete. You have the right to request that we delete any personal information that we have collected from you, subject to certain exceptions.

Your Right to Correction. You have the right to request that we correct inaccurate personal information about you.

Your Right to Opt-Out of Sale/Sharing. You have the right to request that we not “sell” or “share” your personal information to or with third parties, as defined under the CCPA. As described in the Privacy Policy, cookies and other technologies may be used on our sites to recognize you and receive information about your activity on our websites. This helps customize content and show you more relevant ads. Please note that if you make a request to opt-out of sale or sharing and you would like to opt-out of cookie-based tracking for behavioral advertising purposes, you can manage your cookie preferences on your browser or visit About Our Ads for more information about how to opt-out.

Your Right to Nondiscrimination. You have the right not to receive discriminatory treatment for the exercise of privacy rights conferred by the CCPA. We do not discriminate if you choose to opt-out or exercise your rights under the CCPA. If we offer you a financial incentive permitted under the CCPA and not prohibited by other applicable laws and regulations, we will notify you of the material terms of the incentive or incentive program. Participation is voluntary and you may withdraw at any time by emailing us at Privacy Matters.

Additional Information for California Residents:

Sensitive Personal Information. Depending on your level of interaction with us, we may collect sensitive personal information with your consent, such as Social Security numbers, driver’s license, state identification and passport data, race, ethnicity, medical information, and account information. For example, sensitive personal information may be used to process admissions and financial aid applications. We do not sell or share sensitive personal information for the purpose of cross-context behavioral advertising.

Categories of Personal Information. The categories of personal information collected from and about consumers are listed in Section 4 of the Privacy Policy.

Categories of Sources. The categories of sources from which we may obtain your personal information are listed in Section 3 of the Privacy Policy.

Use and Disclosure of Your Personal Information. We may use and/or disclose the following categories of personal information we collect about you for one or more business or commercial purposes.

Categories of Third Parties. We may disclose your personal information for a business purpose to the categories of third parties described in Section 6 of the Privacy Policy, including:

  • Entities owned in whole or in part by us or our parent company and/or its shareholders.
  • Government agencies, regulators, accreditors, law enforcement, and other authorities entitled to such personal information pursuant to law or regulation.

  • A third party with a legitimate educational interest pursuant to FERPA or similar applicable state regulation.
  • Service providers fulfilling a business purpose for us, such as:
    • Professional advisers including, but not limited to, auditors, bankers, insurers, legal counsel, and professional subject matter experts.
    • Organizations we contract with for articulation (e.g., transfer of credit agreements) and affiliation purposes (e.g., internship/externship agreements).
    • Organizations we contract with to improve our Services, improve student retention, our internal inquiry model system, and overall user experience.
    • Background check providers for job candidates and/or students.

“Sales” and “Sharing” of Personal Information. The following categories of personal information may have been sold or shared with a third-party for purposes of cross-contextual behavioral advertising:

  • Personal identifiers, such as name, phone number and e-mail address;
  • Internet or other electronic network activity information, such as IP address, type of browser, device identifiers, device event information, make and model of the device, and mobile advertising identifiers; and
  • Information about your use of the Services.

Each of the categories of personal information listed above may be sold to or shared with the following categories of third parties: advertising publishers that place advertisements on our behalf, advertising partners, and education partners.

Exercising Your California Privacy Rights. To exercise any privacy rights under California law, a California resident may submit their request as follows:

The California "Shine the Light" law of 2003 provides consumers residing in California the right to ask us one time each year if we have disclosed their personal information to third parties for the third parties’ direct marketing purposes. COLORADO RESIDENTS: YOUR COLORADO PRIVACY RIGHTS

The Colorado Privacy Act (“COPA”) gives residents of Colorado certain rights around the collection, use, and sharing of their personal data.

Your Rights. If you are a resident of Colorado, you have the right under the COPA, subject to several exceptions and limitations, to:

  • Request to know what personal data we have collected about you and to access that information;
  • Request to correct inaccuracies in the personal data we maintain about you;
  • Request deletion of your personal data (subject to certain exemptions);
  • Request a copy of your personal data;
  • Request to opt-out of the sale (as defined in the COPA) of your personal data;
  • Request to opt-out of targeted advertising; and
  • Appeal a denial of any request

  • Request to correct inaccuracies in the personal data we maintain about you;
  • Request deletion of your personal data (subject to certain exemptions);
  • Request a copy of your personal data;

We do not sell or share sensitive personal information for the purpose of cross-context behavioral advertising.

Note that for purposes of this section, personal data does not include information about job applicants, employees and other of our personnel; or information about employees and other representatives of third-party entities we may interact with.

VIRGINIA RESIDENTS: YOUR VIRGINIA PRIVACY RIGHTS

The Virginia Consumer Data Protection Act (“VACDPA”) gives residents of Virginia certain rights around the collection, use, and sharing of their personal data.

Your Rights. If you are a resident of Virginia, you have the right under the VACDPA, subject to several exceptions and limitations, to:

  • Request to know what personal data we have collected about you and to access that information;
  • Request to correct inaccuracies in the personal data we maintain about you;
  • Request deletion of your personal data (subject to certain exemptions);
  • Request a copy of your personal data;
  • Request to opt-out of the sale (as defined in the VACDPA) of your personal data;
  • Request to opt-out of targeted advertising; and
  • Appeal a denial of any request

We may “sell” certain categories of personal information in Sections 3 and 4 about Virginia residents as the term is defined under VACDPA, including identifiers, internet or other electronic network activity information, and information about your use of the Services. We may “sell” these categories of personal information to the categories of parties described in Section 6 of this Privacy Policy, including for the advertising, promotional, and other purposes described in Section 5 of this Privacy Policy. Part II – International Laws and Regulations

CANADIAN RESIDENTS: YOUR CANADIAN PRIVACY RIGHTS

The Canadian federal Personal Information Protection and Electronic Documents Act (“PIPEDA”), British Columbia’s Personal Information Protection Act (“BC PIPA”), and Alberta’s Personal Information Protection Act (“AB PIPA”), gives residents of Canada certain rights around the collection, use, sharing and protection of their personal data (collectively, the “Canadian Privacy Laws”).

Accountability. We are responsible for personal information in our possession or custody, including information that has been transferred to a third-party service provider for processing or storage. Section 11 of the Privacy Policy discusses our policies and practices with respect to service providers outside Canada.

The individual designated to oversee our compliance with this Policy is the Chief Privacy Officer. You may contact Privacy Matters with questions about the organization’s policies and practices with respect to our service providers outside of Canada and for questions about the collection, use, disclosure or storage of personal information by service providers outside of Canada.

I dentifying Purposes. The purposes for which personal data is collected are outlined in Sections 1 and 5 of the Privacy Policy.

Consent. Your consent is required for the collection, use, or disclosure of your personal data. Accordingly, we make a reasonable effort to ensure that you are advised of the purposes for which the personal data will be used. In certain circumstances, consent with respect to use or disclosure may be sought after the information has been collected but before use (for example, if we want to use information for a purpose not previously identified). We will not, as a condition of our Services, require you to consent to the collection, use or disclosure of personal data beyond that required to fulfill the specified and legitimate purposes.

Where we seek express consent, it can be given in many ways. For example,

  • an application form may be used to seek consent, collect information and inform you of the use that will be made of the information. By completing and signing or e-signing the form, you are giving consent to the collection and the specified uses;
  • a checkbox on a form may be used to allow you to request information about our Services;
  • consent may be given orally when information is collected over the telephone;
  • consent may be given by contractual agreement; and
  • consent may be given by action on your part (for example, by using,
  • acquiring or accepting the Services).

In limited circumstances, personal data can be collected, used or disclosed without your consent. For example, legal, or security reasons may make it impossible or impractical to seek consent.

Consent is valid for the length of time needed to achieve the identified purposes. You may withdraw consent on reasonable notice, subject to legal, regulatory, security or contractual restrictions. The withdrawal of your consent may result in us being unable to provide you with the Services

Limiting Collection. The collection of personal data shall be limited to that which is necessary for the purposes identified by us in the Privacy Policy. Information is collected by fair and lawful means.

Limiting Use, Disclosure and Retention. We may provide personal data to others as outlined in Section 6 of the Privacy Policy. We may retain your personal information as outlined in Section 11 of the Privacy Policy. We have implemented and will maintain policies and procedures with respect to the retention of personal data, including minimum and maximum retention periods and guidelines and procedures to govern the destruction of personal data.

Accuracy. The extent to which personal data will be accurate, complete and up-to-date will depend upon the use of the information. Personal data that is used on an ongoing basis, including information that is disclosed to third-parties, will be accurate and up-todate. We will not routinely update personal data unless it is necessary to fulfill the purposes for which it was collected.

Safeguards. Security measures are outlined in Section 10 of the Privacy Policy. Personal information shall be protected by security measures appropriate to the sensitivity of the information. The nature of the safeguards varies depending on the sensitivity of the information that has been collected, the amount, distribution and format of the information and the method of storage. More sensitive information is safeguarded by a higher level of protection.

Openness. Information about our policies and procedures related to the management of personal information are available in our Privacy Policy and other publications, such as our catalog, contractual agreements and student disclosures.

Your Access. You have the right under the Canadian Privacy Laws, subject to several exceptions and limitations, to:

  • Request to know what personal data we have collected about you and to access that information;
  • Request to correct inaccuracies in the personal data we maintain about you;
  • Request a copy of your personal data;
  • Request an account of the use that has been made, or is being made, of the personal data, as well as an account of the third-parties to which the personal data has been disclosed; and
